Serbia Introduces European Accident Report for Minor Traffic Incidents

In Serbia, drivers involved in minor traffic accidents can opt to use the European Accident Report instead of involving the police, provided certain conditions are met. This report is applicable when there are no injuries and both parties agree on who is responsible for the accident. It is designed for situations where the material damage is estimated to be up to 200,000 dinars.

The European Accident Report serves as an alternative to a police report for documenting minor accidents. Drivers receive this form along with their car insurance policy, and it is recommended to keep it in the vehicle at all times. The form should be used when both parties involved in the accident concur on the details of the incident. However, it is important to note that the 200,000 dinar figure is not a strict limit for insurance payouts based on the report. Drivers are not professional appraisers, and what might appear as minor damage could potentially require costly repairs.

Accurate documentation is essential for filing insurance claims. The report must be filled out carefully, with all necessary information about the drivers, vehicles, and insurance details included. The form also requires a clear sketch of the accident scene and the positions of the vehicles involved. Both drivers must sign the form, and each should retain a copy. Illegible information or unclear sketches can complicate the resolution of claims later on.

In cases where there is disagreement about the accident details, or if there are injuries or significant material damage, it is advisable to call the police. The police can then document the accident through an official investigation. This is crucial when there is no consensus on responsibility, as signing a description that one disagrees with just to expedite the process is not advisable. The police should also be called if there is any suspicion of injury, as assessing health takes precedence over discussing vehicle damage and repair costs.

The signature on the European Accident Report does not automatically imply an admission of guilt. Instead, it confirms the identity of the participants and the circumstances as described in the form. It is important for drivers to review the completed form thoroughly before signing it. Taking photographs of the vehicle positions, damage, and license plates, as well as exchanging driver and insurance information, is also recommended. This documentation aids in ensuring that the claim is not solely reliant on verbal accounts of the accident.

The Serbian Ministry of Internal Affairs warns that if all parties leave the scene of a minor accident without completing the European Accident Report, it is not possible to conduct a subsequent investigation or create an official record at their request. Therefore, documenting the accident should be completed before the parties separate, while all participants, vehicles, and circumstances are still available for verification.
